Heard learned counsel for the applicant and the learned AGA for the State.
The applicant through the present application under Section 482 Cr.P.C. have
invoked the inherent jurisdiction of this Court with the prayer that the applicant be
allowed to furnish fresh bail bonds in newly added Section 407 IPC in Case Crime
No. 472 of 2009, PS Hanumanganj, District Kushinagar, as he has not misused the
liberty of bail granted to him earlier for the offence under Section 406 IPC in the
same crime number.
The prayer of the applicant for the fresh bail bonds cannot be accepted.
However, looking to the facts and circumstances of the case and also the fact that
the applicant has not misused his liberty of bail granted to him earlier, I consider it
proper to direct the Court below to dispose off the bail application of the applicant for
the aforesaid offence, in view of judgement passed by Hon’ble Apex Court reported
in 2009 (3) ADJ (322) (SC) Lal Kamlendra Pratap Singh Vs. State of U.P.
With the aforesaid direction, this application is finally disposed off.
