Heard learned counsel for the parties.
I have perused the order passed by appellate
Court as well as by trial Court upon application filed
under Order 39 Rule 1 and 2 read with Section 151
C.P.C. in a suit filed by the petitioner. In my
opinion, no interference is required in this case
because the respondents were allotted land by the
District Collector and the District Collector is not a
party in the original suit.
Accordingly, the writ petition is dismissed.
However, I deem it just and proper to direct the trial
Court to decide the suit expeditiously within a period
of six months.
