Background
1. The Applicant filed an RTI application dt.29.3.10 with the PIO, DRM Office, Western Railway, Mumbai
seeking the following information:
i) Certified copies of the pages of the Reservation rosters of the last 15 years i.e.
from 1995 onwards till date for Sr.Asst. Loco Pilot, Loco Pilot Gr.II, Loco Pilot Gr.I and
Loco Pilot M/Exp.,
ii) Copies of yearly returns which are to be sent to the GM Office, Railway Board
and National Commission regarding these reservation rosters.
iii) Copies of details of the inspection of these Reservation Rosters for the
categories mentioned above by Liaison Officers, Divisional Officers, Personnel Officers,
their inspection report for the last fifteen years,
iv) Copies of the assessment of vacancies of the above mentioned categories of
staff for the last fifteen years showing the posts assessor for General, SC and ST
categories.
Shri B. Ramachandran, PIO replied on 26.4.10 enclosing the information furnished by
shri A.K.Shrivastava, APO(M) BCT who vide his note dt.15.4.10 invited the Applicant to
inspect the records for information against points 1, 3 and 4. The Information against
point 2 was provided by APO(G)BCT who vide his note dt.20.4.10 also invited the
Applicant for inspection of records. The Applicant filed an appeal dt.7.5.10 with the
Appellate Authority stating that no certified copies of the specified documents have been
provided and he has been given the liberty to attend PIO’s office. He added that earlier
also, he had attended the PIO’s office for examining of documents and he was misled by
the dealing staff regarding those documents and still he has not been provided those
documents. Moreover, during his duty, he is unable to get sufficient leave and time to
attend the PIO’s office. Shri A.K.Jha, Appellate Authority vide his order dt.2.7.10 directed
that information held by Sr.DPO/Mumbai Central & PIO, Personnel Branch in material
form be supplied to the Applicant by 30.7.10. Being aggrieved with the reply, the
Applicant filed a second appeal dt.14.9.10 before CIC.
Decision
2. During the hearing, Ms.Rekha Yadav, Respondent PIO submitted that in compliance with the
Appellate Authority’s order complete information was provided on 29.7.10. She added that the
deemed PIO had supplied information to the CPIO However the same was received by the
Appellant only on 29.12.10. Responding to the Appellant’s complaint about nonreceipt of
information against point 1, Ms.Rekha Yadav submitted that the same was provided on 29.12.10.
With regard to the points 2 and 3, she added that information as sought by the Appellant does not
exist as there are only periodic inspections. Hence no information is available against these points.
3. The Commission holds that complete information has been provided and that the PIO is under no
obligation to furnish further information and accordingly disposes of the appeal .
