The appellant had asked in his RTI application that, please inform me, how many
Building’s are constructed in terms of illegal method in the Ward No. 2, Mehrauli, New Delhi.
also provide name of property holder. What action had been taken by the department (MCD)
on the said illegal construction? Two Building’s are constructed House No. 92 and House No.
178A next to Ward No. 2, Mehrauli, please give information that, these construction are
illegal or not. If yes, why action had not been taken about said matter.
PIO replied.
These are illegal properties and action is going on as per DMC Act, 1957.

The following were present.
Appellant: Mr. Satish Kumar
Respondent: Mr. R.K. Sharma Ex. Engr. Deemed PIO
The appellant is seeking information about action taken against illegal construction near his
house. The respondent states that unless the plot nos. are given it is difficult for them to
identify the construction. However the PIO has brought the list of illegal constructions in ward
no. 2. Mr. R.K.Sharma states that they are not able to take prompt action against illegal
construction without police protection and such protection is not provided as per the
requirement, hence they are unable to take adequate action against illegal construction.
Decision:
The Appeal is allowed.
The PIO will give the list of illegal constructions in ward no. 2 with copies of notices issued to
the appellant before 30 March 2009.
This decision is announced in open chamber.
Notice of this decision be given free of cost to the parties.
