2. 09.02.2011. Heard learned counsels for the petitioners and the State.

It is submitted by the learned counsel for the petitioners

that the petitioner no. 3, namely, Satya Narayan Ram, of Cr. Misc.

No. 1477 of 2011 has been arrested. Hence, he seeks permission to

withdraw the application of petitioner no.3. Permission is

accorded.

So far petitioner nos. 1,2,4 and 5 are concerned, they are

alleged to have misappropriated the advance money given under

‘Sampurna Gramin Rojgar Yojna’ for construction of work.

Annexure-2 has been brought on record which reflects that after

lodging of F.I.R. the works have been completed.

It is submitted by the learned counsel for the petitioners

that in all the three Criminal Miscellaneous applications the works

have been completed subsequent to the filing of the F.I.R. It is

further submitted that similarly situated accused persons have been

granted anticipatory bail vide Cr. Misc. No. 36748 of 2010 and Cr.

Misc. No. 30922 of 2010.

Considering the aforesaid facts, let the petitioners, Ajay

Kumar Singh, Yogendra Pal, Sheobachan Ram, Raj Mohan Ram,

Brij Keshwar Ram and Dilip Kumar Singh be released on bail in

the event of arrest or surrender before the learned court below

within a period of twelve weeks from today in connection with

Akorhi Gola P.S. Case No. 113 of 2009 on furnishing bail bond of

Rs. 10,000/-(Ten Thousand) each with two sureties of the like

amount each to the satisfaction of the learned C.J.M., Rohtas,

subject to the conditions as laid down under Section 438(2) of

Code of Criminal Procedure.
