Background
1. The Applicant filed an RTI application dt.25.12.06 with the CPIO, DRM,
Bhavnagar. He requested for information against 13 points with regard, to
his pay, transfer and seniority. The CPIO replied on 19.1.07 furnishing point
wise information. Not satisfied with the reply, the Applicant filed an appeal
dt.14.2.07 with the Appellate Authority. The Appellate Authority replied on
22.5.07. The applicant filed a second appeal dt.5.6.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for May 11, 2009.
3. Mr. J.M. Padaya, APO & CPIO and Mr. R.M. Bhatt, OSII represented the Public
Authority.
4. The Appellant was present during the hearing.
Decision
5. With regard to points 2, 3, 7 & 8, the Commission holds that the issues
raised by the Appellant relate to administrative decisions of the Public
Authority related to pay, transfers, payment of arrears, posting and seniority
and do not come under the purview of the RTI Act. With regard to point 1
information has already been provided. Information regarding date of
relieving is to be provided against point 4. As for 9(c) and 10(c), the CPIO is
directed to provide available information. With regard to 10(d) & 10(e) of
the RTI request , clarification is to be provided regarding cancellation of
promotion orders and revision of promotion. As for points 9 (a) & 9(b), the
Appellant stated that he is satisfied with the information provided to him. All
information to be provided by 10th June, 2009.
6. The appeal is disposed off.
