                            J U D G M E N T

The petitioner is a Deputy Director of Education in the

Department of Education of the Government of Kerala. The petitioner

has been subjected to disciplinary proceedings, which resulted in

imposition of a punishment by Ext. P1 order. The petitioner has also

been overlooked for promotion apparently in view of the disciplinary

proceedings. Against the order of punishment, the petitioner has

filed Ext. P2 review petition under Rule 35 of the Kerala Civil Services

(Classification, Control and Appeal) Rules. Against the non-

consideration of the petitioner for promotion, the petitioner has filed

Exts.P.3, P6 and P7 before the Departmental Promotion Committee.

The petitioner now seeks a direction to the 1st respondent to consider

and pass orders on Ext. P2 and a direction to the 2nd respondent to

consider and pass orders on Exts.P3, P6 and P7.

2. I have heard the learned Government Pleader also.

In the facts and circumstances of the case, this writ petition is

disposed of with the following directions:

The 1st respondent shall consider and pass orders on Ext. P2 as

expeditiously as possible, at any rate, within three months from the

date of receipt of a copy of this judgment, after affording an

opportunity of being heard to the petitioner. Likewise, the 2nd

respondent shall consider and pass orders on Exts.P3, 6 and 7 as

expeditiously as possible, at any rate, within three months from the

date of receipt of a copy of this judgment. While dealing with Exts.

P2, P3, P6 and P7, the respondents shall take into account the fact

that the petitioner is due to retire on 31.3.2011 and try to pass orders

on Exts.P2, P3, P6 and P7 expeditiously so that if the petitioner is

entitled to, the petitioner can enjoy the fruits of the orders to be

passed before her retirement.
