The
present petition was earlier listed for hearing on 15th
March 2010 and 08th April 2010. Thereafter, it has been
listed for hearing today. However, today Mr.J.N. Jadeja, learned
advocate for the petitioner,
is not present when the matter is called out.
When
this matter came up for admission hearing, it has been admitted and
has been ordered to be heard with Special
Civil Application No.1781 of 1994. It is pertinent to note
that the said Special Civil
Application No.1781 of 1994 has been disposed of by this
Court (Coram : D.H. Waghela, J) vide order dated 30th
October 2009.
However,
in view of aforesaid and as none appears on behalf of learned
advocate for the petitioner,
the matter is dismissed for default. Rule is discharged with no
order as to costs. Interim relief, if any, stands hereby vacated.
