Background
1. The Applicant filed his RTI application dt.25.9.08 with the CPIO, RPO,
Ghaziabad. He requested for information against 3 points with regard to the
implementation of CIC Order No.CIC/OK/A/2008/00001 dt.31.7.08. The CPIO
replied on 23.10.08 providing following information.
i) The passport to Shri Ajay Kumar Jain was granted by Shri R.N.Rai, Dy.
Passport Officer and it was signed by Smt.Avinash Mahajan, Superintendent.
ii) A writ petition has been filed against the decision of CIC in the Hon’ble
High Court, Delhi. Hence, the amount of compensation has not been paid to
Shri Ajay Kumar Jain.
iii) The explanation was called from Smt.Veena Sharma, Superintendent
of Z Group, Shri Vibhiti Bhushan, LDC, Dealing Assistant of Z Group, Shri
Manoj Kumar Silswal, Group D for feeding the objection and Shri
R.K.Srivastava, NIC Incharge. The work of detail entry is outsourced to
NICSI.
The applicant filed an appeal dt.10.11.08 with the Appellate Authority. In his
appeal, he raised following points:
i) PIO has tried to mislead him. The Hon’ble Commission has given a
clear order to make the payment by 29.8.08. The PIO has not mentioned the
date on which the writ petition was admitted as well as the name of the
person who filed the petition. Is it on personal level or from the public
exchequer.
ii) PIO has not sent the copy of the departmental rules.
On not receiving any reply, he filed a second appeal dt.16.12.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for February 19, 2009.
3. Mr. Amrendra Kr Sengar, CPIO represented the Public Authority.
4. The Applicant was present during the hearing.
Decision
5. With reference to the second appeal, information with regard to date on which
the writ petition was filed and the name and designation of the person filing
the same to be provided to the Appellant. A certified copy of the
Departmental Rules as sought in point 3 of RTI request also to be provided.
All information to be provided within 15 days of receipt of this Order.
6. The appeal is disposed off.
