ORDER

Present
application has been preferred by the applicants original
accused under sec.439 of the Code of Criminal Procedure to release
them on bail contending inter-alia that despite the order passed by
this Court, the learned trial court has not concluded the trial.

This
Court passed the following order on 7/5/2010:-

It
is reported that Mr.Shrikar Bhatt, learned Advocate for the
applicants has filed sick note. Hence, stand over to 18th
June, 2010.

This
Court has received report from the learned Principal District Judge,
Himatnagar along with report from the learned Principal Civil Judge
and JMFC, Vijaynagar. Considering the same, learned Trial Court is
directed to complete the trial of Criminal Case No.422 of 2008 on or
before 18th June, 2010 and conduct the trial as far as
possible on day to day basis. Registry is directed to communicate
this order to the learned Trial Court immediately.

It
is reported that today also Mr.Shrikar Bhatt, learned
advocate appearing on behalf of the applicants is not
available due to Leave-Note. However, it is reported by the Registry
that the learned trial court has already concluded the hearing and
is likely to pronounce the judgement today.

In
view of the above present application has become infructuous and is
disposed of as having become infructuous.
