1.0 By
way of present petition, the petitioner has prayed for following
relief/s:
(a) be
pleased to admit this petition.
(b) be
pleased to issue a writ of mandamus or any other appropriate writ,
order or direction in the nature of mandamus, directing the
respondents to release the amount of increments withheld till final
hearing of this petition and further be pleased to direct the
respondents not to withhold any of the increments of the
petitioner and thereafter for the reason of not passing
language examination and further direct them to pay the arrears:
(c) be
pleased to issue a writ of mandamus or any other appropriate writ,
order or direction, directing the respondents to exempt the
petitioner from passing Gujarati Language Examination with effect
from the date of appointment on the post along with the other
persons who were exempted by amendment of the rule under 1972;
(d) be
pleased to issue a writ of mandamus or any other appropriate writ,
order or direction declaring that the Gujarat Government Servants
(Lower Standard and Higher Standard Gujarati Language Examination)
Rules, 1970 as amended in 1972 as ultra vires Articles 14 and 16 of
the Constitution of India.
2.0 Having
perused the materials produced on record, it transpires that by
efflux of time, the petition has become infructuous. Hence, the
petition stands disposed of as having become infructuous. Rule is
discharged with no order as to costs. Interim relief, if any, stands
vacated. Liberty to revive in case of difficulty.
