This matter was heard on 30.03.2009 through videoconferencing.
Appellant was present at NIC Studio at Ajmer. Respondents’
representatives were present at NIC Studio at Mumbai. Commission
conducted the hearing from the NIC facility at its New Delhi office.
2. This second-appeal is related to appellant’s RTI-application dated
06.05.2008. The Appellate Authority, through his directive dated
05.09.2008, asked CPIO, Shri J.P. Sheokand to answer the requests for
information made by the appellant. This order was passed by the
Appellate Authority after CPIO failed to provide a reply to the
appellant’s RTI-application.
3. It is seen from the records that CPIO did not comply with the
Appellate Authority’s orders dated 05.09.2008.
4. The CPIO is, therefore, directed that he shall comply with the
Appellate Authority’s order within two weeks of the receipt of this
decision.
Complaint:
5. Complaint proceedings may be separately started against the
CPIO, Shri J.P. Sheokand for his failure to comply with the Appellate
Authority’s orders thereby obstructing disclosure of information to the
appellant.
6. Appeal disposed of with these directions.
7. Copy of this direction be sent to the parties.
