Heard learned counsel for the applicant and learned Additional
Government Advocate.
It is argued by the learned counsel for the applicant that the main
role of firing on the deceased has been assigned to the co-accused
Ahmad, whose case is distinguishable from the case of the
applicant. Four persons have been implicated in this case. So far as
the applicant and two other persons are concerned, they have only
been assigned the role of exhortation.
Learned AGA argued that the applicant and co-accused have
formed a gang and they were preventing the deceased from
harvesting his crop and in this context the incident has taken place.
There is a history sheet of the co-accused Babban and so far as the
applicant is concerned, proceedings under NSA were initiated
against him.
Learned counsel for the applicant replies that NSA has been
revoked.
Having considered the submissions of the parties and without
expressing any opinion on the merits of the case, let the applicant
Kasam, involved in case crime No. 283 of 2009, under sections
302/506 IPC and 7 Criminal Law Amendment Act, police station
Chhajlet, district Moradabad, be released on bail on his furnishing
a personal bond with two sureties each in the like amount to the
satisfaction of the Court concerned.
