The incomplete counter affidavit filed
today by Mr. Suresh Choudhary does not serve
the purpose.
Counsel for the State has accordingly
prayed for further indulgence, in order to
clarify the aspect relating to supply of
Inquiry Report, now after taking instructions
from the Regional Deputy Director of
Education, Saharsa.
That being so, list this case day after
tomorrow i.e. 16.11.2011, in order to enable
the respondents to file their supplementary
counter affidavit as also produce the records
of the departmental proceeding of the
petitioner. It is made clear that if the
supplementary counter affidavit as directed
above and/or the records of departmental
proceeding would not be produced, the present
Regional Deputy Director of Education, Saharsa
shall also be required to appear in person in
addition to the officials present today who in
any event shall also remain present on that
date.
