Facts

arising from the Complaint:

Mrs. Jameela had filed an RTI application dated 18/10/2010 with the PIO &
AC(NE), Consumer Affairs, Food and Civil Supplies, GNCTD, Delhi asking for certain
information. On not having received any information within the mandated time the
Complainant filed a Complaint under Section 18 of the RTI Act with the Commission.
On this basis, the Commission issued a notice to the Respondent on 28/01/2011 with a
direction to provide the information to the Complainant and further sought an explanation
for not furnishing the information within the mandated time.

The Commission received a letter dated 03/02/2011 from the PIO & Asst.
Commissioner (NE), Food and Supplies Department, stating that the reply of the said RTI
was sent to the applicant on 12/11/2010 through speed post, which was received back in
his office on 16/11/2010 with remarks ‘address not found’. It is further mentioned that
the Complainant had filed a First Appeal on 26/11/2010 alleging that he was not satisfied
with the reply provided by the PIO. The FAA had passed an order on 16/12/2010
disposing the First Appeal, since the Complainant was not present to give reasons as to
why she is not satisfied with the reply furnished by the PIO. Hence, it appears that the
information was furnished by the PIO within the mandated time i.e. 30 days.

Decision:

The Complaint is disposed off.

Notice of this decision be given free of cost to the parties.
