2 15-10-2011 Heard learned counsels for the petitioners and the State.

The petitioners being the police personals are apprehending

their arrest in a case registered under Sections 147, 149, 336, 337,

341, 323, 186, 353 and 427 of the Indian Penal Code.

It is alleged that the police personals of SAP made protest

with regard to the payment of advance on the eve of election.

It is submitted that the specific accusation of leading the

protestors is against Arun Kumar Pandey who is not the

petitioner before this Court. Moreover, the protest was bona fide

since the SAP people were given lesser amount of advance than

the general Bihar Police.

Considering the aforesaid facts, let the above named

petitioners be released on anticipatory bail in the event of their

arrest or surrender before the learned court below within a period

of twelve weeks from today, on furnishing the bail bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount

each to the satisfaction of learned Chief Judicial Magistrate,

Rohtas, Sasaram in connection with Dehari Town P.S. Case No.

221/2011 subject to the conditions as laid down under Section

438(2) of the Cr.P.C.
