Heard Mr. Ram Raj Pandey, learned counsel for the petitioner, learned
AGA for the State and perused the record.
Admit.
Issue notice to respondent no. 2, who may file counter affidavit within two
weeks. Rejoinder affidavit, if any, may be filed within one week thereafter.
List immediately after expiry of the aforesaid period.
By the next date of listing the operation of the impugned order dated
14.5.2010 passed by the Additional District and Sessions Judge (Special),
Baghpat and of the order dated 23.7.2009 passed by the Additional Chief
Judicial Magistrate, Baghpat in Case No. 80 of 2009 (Annexure nos. 7 & 5
respectively to the writ petition) shall remain stayed provided the petitioner
pays all the due amount till September 2010 calculated at the rate of one half
of the amount as awarded by the trial court by 30.9.2010 and continues to pay
the same by 7th day of each month from October 2010.
The amount so deposited by the revisionist may be withdrawn by
respondent no. 2.
