1. Heard
learned advocate Mr. H. S. Munshaw appearing for Bhavnagar Municipal
Corporation and learned advocate Mr. P. V. Hathi appearing for
original respondents.
2. This
application is preferred by Bhavnagar Municipal Corporation while
filing Misc. Civil Application for recalling order which has been
passed in Second Appeal No.88 of 1998 dated 14/12/2010. There is a
delay of 223 days in filing Misc. Civil Application.
3. I
have considered submissions made by learned advocates appearing on
behalf of respective parties and also considered averments made in
present civil application supported with affidavit of Legal Officer
of Bhavnagar Municipal Corporation. Considering it, delay of 223
days in filing Misc. Civil Application is condoned in the interest of
justice as sufficient cause has been shown by applicant to the
satisfaction of this Court.
4. Accordingly,
present Civil Application is disposed of.
5. The
registry is directed to register Misc. Civil Application accordingly
as delay is condoned.
