The aforementioned application has been filed on behalf of the petitioner
for reconstruction of the record of the Writ Petition.
Registry is directed to give appropriate number to the said Application.
It appears from the Office-Note that the Original Writ Petition has been
lost. The Second Judge’s Copy is, however, available on the record. The
Second Judge’s Copy may be treated as the Original Writ Petition. Counsel
for the petitioner has supplied another copy of the Writ Petition duly certified
by him as true copy, which will be treated as the Second Judge’s Copy of the
Writ Petition.
It further appears that on 13.1.2010, an order was passed in the present
case.
As the Original Petition, on which the Order dated 13.1.2010 would have
been noted, has been lost, a copy of the said Order has been taken out from
the Computer. The contents of the said Order dated 13.1.2010, as contained in
the said copy, are as follows, and the same may be treated as the order that
was passed on that date on the Writ Petition:
“On oral prayer made by Sri Radha Kant Ojha, learned counsel for the
petitioner, he is permitted to implead the District Magistrate, Ballia as
respondent no. 3.
Necessary amendments will be made in the Writ Petition as well as in the
Stay Application during the course of the day.
On prayer made by Sri Pankaj Saxena, learned Standing Counsel
appearing for the respondents, the case is directed to be put-up as fresh on
21.1.2010 so as to enable him to obtain instructions in the matter, as directed
by the Order dated 7.1.2010.”
Let the Writ Petition be put-up as fresh on 3.2.2010.
