: In this writ petition, the petitioner has prayed for quashing
the order dated 15th March, 2007, whereby the petitioner’s service
has been terminated. He has also prayed for quashing the order
of the appellate authority, as the appellate authority has not
considered the facts and materials on record and upheld the
order of the disciplinary authority.
It has been submitted that the petitioner was prosecuted
for the criminal charges and after trial, he has been acquitted.
The said respondents have not taken consideration of petitioner’s
defence and material brought on record and awarded the said
punishment, ignoring the said order of the Court of Law. The
petitioner preferred revision/ memorial before the Director
General of Police, Jharkhand as far back as on 12th June, 2009,
but till date no decision has been taken on the said memorial.
Learned J.C. to A.G., appearing on behalf of the
respondents, submitted that if the petitioner’s revision/memorial is
still pending before the Director General of Police, Jharkhand,
the same shall be taken up and disposed of without any further
delay. He further submitted that it will be better for the petitioner
if he files a copy of the said memorial before the Director
General of Police, Jharkhand for ready reference.

Considering the said submissions, this writ petition is
disposed of, directing the Director General of Police, Jharkhand
Respondent no.2 to consider the petitioner’s revision/memorial
and pass appropriate order, in accordance with law, within two
months from the date of receipt/production of a copy of this
order. The petitioner, in the meanwhile, may file a copy of the
memorial before the said respondent, as suggested by learned
counsel for the respondents.
