Heard
learned Advocate Mr. Umang Choksi for petitioner and Mr. AL Sharma,
learned AGP for respondent State Authority.
Deputy
Collector has passed order on 22.7.2003 and thereafter, 25 per cent
amount has been deposited by petitioner on 26.9.2003 and appeal is
also preferred on 26.9.2003. Learned Advocate Mr. Choksi for
petitioner submits that more than seven years have passed but appeal
is still pending before appellate authority and not decided and,
therefore, this petition is filed by petitioner.
In
view of these facts, it is directed to respondent NO.2 Chief Revenue
Controlling Authority to decide appeal of petitioner, if it is filed
in time by petitioner, in accordance with law within period of three
months after giving reasonable opportunity of hearing to petitioner
and to communicate decision to petitioner immediately, if it has not
been decided so far by respondent authority till this date.
With
these observations and directions, this petition is disposed of by
this Court without expressing any opinion on merits.
