                                  JUDGMENT

H.L.Dattu, C.J.

Inter alia, alleging that the respondent has wilfully and voluntarily

disobeyed the orders and directions issued by this Court in W.A.No.144 of

2008, the complainant is before us with a request to initiate appropriate

proceedings against the respondent as provided under the provisions of the

Contempt of Courts Act, 1971 read with Article 215 of the Constitution.

2. The respondent is served and he is represented through his learned

counsel.

3. At the time of hearing of this matter, it is brought to our notice by the

learned counsel appearing for the respondent that the order passed by this

Court in W.A.No.144 of 2008 has been stayed by the apex Court in

S.L.P.No.11623 of 2008.

4. In view of this development, in our opinion, at this stage, it may not

be appropriate for this Court to continue with this contempt proceedings.

Accordingly it is disposed of for the present. Liberty is reserved to the

complainant to approach this Court immediately after the disposal of

S.L.P.No.11623 of 2008 pending before the apex Court.

Ordered accordingly.
