Facts
:
1. Dr. M.L. Gupta preferred RTI application dated 9
November 2009 before the CPIO, United India Insurance
Company Limited, Divisional Office, Gwalior seeking
information pertaining to the rules under which the
Regional Chief had the powers to retain the request
for transfer application under Transfer and Mobility
Policy for Officers along with grounds on which the
same had been held back in case the Regional Chief
was not empowered to do so.
2. The CPIO vide his order dated 22 December 2009
denied disclosure of information on the grounds that
it was outside the scope of the Act.
3. The applicant preferred appeal dated 12 January
2010 before the first appellate authority who
disposed of the matter vide FAA order dated 15
February 2010 vide which the order of the CPIO was
upheld and information denied under section 2(f) of
the Act.
4. Being aggrieved and not being satisfied by the
above decisions the appellant moved the Commission in
second appeal. The matter was heard today through
videoconferencing. Both parties were present as above
and presented arguments.
Decision
5. After hearing both parties the Commission
directs that information sought by the appellant
falls well within the scope and definition of
information as defined under section 2(f) of the Act.
Accordingly respondent is directed to provide full
and complete information on all three points as
sought by the appellant within two weeks of receipt
of the order.
