2/- 06.07.2011 Heard learned counsel for the petitioner and

learned counsel appearing for the State.

The petitioner apprehends his arrest in

connection with Rosera P.S. Case No. 54 of 2011 registered

for the offence under sections 341, 323, 504, 353 of the

I.P.C. and section 3(x) of SC/ST Prevention of Atrocities Act.

Learned counsel for the State opposes the prayer

for bail.

Taking into consideration the fact nothing has

been whispered which would show that offence under

section 3 (x) of SC/ST Prevention of Atrocities is made out

as also the fact that the petitioner was staff of circle office,

Rosera and was deputed on election duty and, thus,

causing obstruction to the informant, who is said to be

Choukidar does not seem to be believable and other

sections being bailable, let the petitioner namely Ashwani

Kumar Lal @ Ashwani Kumar Sinha in the event of his

arrest at the hands of police or surrender before the Court

below, be released on bail in connection with Rosera P.S.

Case No. 54 of 2011 on furnishing bail bond of Rs. 5,000/-

(Five thousand) with two sureties of the like amount each to

the satisfaction of the learned Chief Judicial Magistrate,

Rosera at Samastipur.
