This matter was heard through videoconferencing on 08.07.2009.
Appellant was absent, while the respondents’ represented by the CPIO
were present at NIC Studio, Jaipur. Commission conducted the hearing
from its New Delhi Office.
2. This second-appeal is related to appellant’s RTI application dated
NIL, which was replied to by the CPIO on 05.03.2009 and by the
Appellate Authority on 31.03.2009. A copy of the RTI-application is
attached to this order as Annexe.
3. Appellant, in his second-appeal, has stated that the replies he has
received from the CPIO and the Appellate Authority were incomplete
and in certain cases no information was provided. He stated that the
Customs Department was losing crores of rupees from the duty-free
shops and disclosure of the requested information was aimed at
stopping such loss.
4. It is not possible to make out from the submission made by the
appellant as to how the information provided to him by the respondents
was in anyway incomplete or insufficient.
5. In the absence of any such averment by the appellant, it is not
possible for this Commission to impeach the information respondents
have provided to him.
6. The appeal fails. Closed.
7. Copy of this direction be sent to the parties.
