ORAL
ORDER

The
petitioners have challenged an order dated 22.8.2006 passed by the
Principal Secretary (Appeals), Revenue Department, Government of
Gujarat. By the said order, revision application of the petitioners
came to be dismissed. Issue pertains to entries in the revenue
record. Secretary in his order observed that petitioners have
challenged the disputed entries after 15 years. In the meantime, two
block Nos. 247 and 86 were also sold away. Long thereafter, after
change of title also the petitioners tried to raise all the issues.
It was also observed that though initially name of the petitioners
were entered as heir of deceased Atmaram, they agreed for deletion
of name from record of land. Learned advocate Shri Vasavda however,
disputed validity of this statement.

I
have no reason to take a different view. Entries in the revenue
record are meant primarily for fiscal purposes and are not meant to
determine the right, title and interest of the parties. It is always
open for the petitioners to establish their right through civil
Courts in accordance with law.

The
petition is therefore, dismissed. Notice is discharged.
