04 22.07.2011 Heard learned counsel for the petitioner as well as

learned Addl. P.P. for the State.

Petitioner is in jail custody since 8.7.2010 in a case

registered under section 394 of the IPC and 27 of the Arms Act.

Petitioner is not named in the first information report but

it appears from perusal of the impugned order as well as

submissions of the parties that the petitioner was identified in test

identification parade by the informant.

The contention of learned counsel for the petitioner is

that petitioner does not have any criminal antecedent which is

evident from letter no. 1904 dated 7.5.2011 of Senior S.P,

Darbhanga. It is further contended by him that the report of the

learned trial court reveals that up till now charge has not been

framed against the petitioner.

Taking into consideration the above stated facts and

circumstances as well as period of detention of the petitioner in jail

custody, let the petitioner, Vikash Kumar, be released on bail on

furnishing bail bonds of Rs 10,000/- with two sureties of the like

amount each to the satisfaction of the Sub divisional Judicial

Magistrate, Biraul, Darbhanga in Biraul P.S. Case no. 82/2010

subject to the condition that the petitioner shall attend the learned

trial court on each and every date for the period of nine months and

if he fails to do so on three consecutive dates without any

reasonable explanation, the learned trial court shall be at liberty to

cancel the bail bonds of the petitioner.
