1. Heard
Mrs. Ketty Mehta, learned advocate for the petitioner.

2. It
is submitted that the interim relief granted by the Gujarat Revenue
Tribunal is beyond the scope of the relief claimed in the application
for stay made by the respondent no.2.

3. Having
regard to the submissions advanced by the learned advocate for the
petitioner, issue notice returnable on 24th
September, 2008. Mr. R.S. Sanjanwala, learned advocate waives
service of notice on behalf of respondent no.2 and Mr. M.I. Merchant,
learned advocate waives service of notice on behalf of respondent
