Sri Mukesh Kumar Meshram, is present in person in the Court.
Despite being asked for repeatedly, he has not uttered a single word nor has
tried to explain his conduct on the incident which took place on 7.5.2010.
Sri J.N. Mathur, learned Sr. Advocate, however, says that he has remorse and,
therefore, tenders his unconditional apology for whatever has happened on
7.5.2010. He further says that after the aforesaid incident, the L.D.A. or any
officers/officials have not disturbed the peaceful possession of the petitioner
over the property in question. Sri J.N. Mathur and Sri D.K. Upadhyaya, assure
on behalf of the State and on behalf of the L.D.A. that petitioner’s possession
over the property in question shall not be disturbed by the L.D.A. or the State.
Sri S.K. Kalia, learned counsel for the petitioner says that since no
explanation has come forward as per the direction issued by this Court on
17.5.2010 and also on 27.5.2010, therefore, the apology tendered by Sri
Mukesh Kumar Meshram may not be accepted.
Sri J.N. Mathur says that the matter may also be heard finally.
We, under the circumstances, do not feel prima facie satisfied with the
apology tendered and would consider the said matter at the time of hearing of
the writ petition.
Let the hearing of this case be resumed further in the 3rd week of August,
2010. Sri Mukesh Kumar Meshram, however, need not appear in person until
specifically called for. The interim orders granted earlier are confirmed till the
hearing of the case is continued.
