Facts

:­ 

1. The   applicant   preferred   RTI   request   dated   21 
November   2009   before   the   CPIO,   The   New   India 
Assurance Company Limited, Mumbai seeking information 
pertaining   to   the   cadre   of   assistant   in   respect   of 
promotion   policy   –   2008   and   the   breakup   of   marks 
awarded   to   all   the   eligible   candidates   in   the 
promotion   exercise   2009   under   different   heads   along 
with names and total marks obtained.

2. The CPIO vide his letter dated 21 December 2009 
provided   information   on   all   points   of   the   RTI 
application   but   denied   disclosure   of   marks   awarded 
for   CR   on   the   grounds   of   section   8   (1)   (d)   and 
section 8 (1) (j) of the RTI Act.

3. Appellant   preferred   appeal   dated   20   December 
2009   which   was   disposed   of   by   First   Appellate 
Authority   vide   his   order   dated   11   January   2010   by 
upholding the order of the CPIO.

4. Appellant   preferred   second   appeal   before   the 
Commission. The matter was heard today. Appellant was 
present   in   person.   Respondent   was   present   as   above 
and heard through videoconferencing.

Decision

5. Commission   notes   that   respondent   submitted   that 
full   and   complete   information   had   been   provided   to 
the appellant except for the breakup of marks awarded 
to each candidate. Appellant accepted having received 
the information.

6. After   hearing   both   parties   Commission   directs 
respondent   to   provide  total   marks  awarded   to   each 
candidate   on   the   grounds   that   the   entire   promotion 
exercise   of   2009   is   since   completion   over. 
Information   to   be   provided   within   two   weeks   of 
receipt of the order.
