Heard learned counsel for the petitioner, Sri V.K. Ojha, learned counsel
appearing on behalf of respondents No. 2 and 3 and learned Standing Counsel
appearing on behalf of respondent No. 1.
By means of this writ petition, the petitioner has prayed for a mandamus
directing the respondent No. 2 to renew/ issue the permit in the favour of
petitioner as per Resolution of State Transport Authority dated 9.3.1994. The
learned counsel for the petitioner contends that the Regional Manager,
Ghaziabad has directed the petitioner to replace his vehicle since the vehicle
is 9 years old.
The learned counsel appearing for Corporation after obtaining instruction has
submitted that the corporation has taken decision to permit vehicles which are
10 years old, to continue. He has referred to circular dated 22.2.2008 issued
by Transport Deportment Uttar Pradesh clearly stating that the vehicle of ten
year old are permitted to be continued.
In view of the aforesaid, we see no reason to accept the petitioner contention
that he is being asked to replace the vehicle.
The corporation as per its policy has to permit vehicles ten years old to
continue to be run on roads.
In view of the aforesaid, no further order is required in the writ petition. The
writ petition is disposed of.
