L. N. MITTAL, J. (Oral) :

Learned State counsel, on instructions from Head Constable
Balbir Singh, states that pursuant to interim order of this Court, the
petitioner has since joined investigation.

Learned counsel for the petitioner contends that the petitioner
as lambardaar only attested the sale deed and there is no allegation that the
vendors were impersonated. On the other hand, the sale deed was executed
by the vendors, by whom it purports to have been executed. The dispute is
regarding identity of the property, which was allegedly purchased by the
vendee and the property which was mortgaged by the vendee with the bank
for raising loan. It is further contended that the petitioner has nothing to do

with the identity of the property.

In view of the aforesaid, without commenting anything on
merits, interim order dated 21.07.2009 is made absolute. This order shall
remain effective till one month after the filing of the charge-sheet by the
police or till decision of regular bail application of the petitioner, which
ever is earlier.

The petition stands disposed of accordingly.
