ORDER

Initially,
in this matter, learned advocate Mr. MI Patel had appeared on behalf
of appellant, who expired. Thereafter, notice has been issued to
appellant which has been served as per endorsement made by Registry
but it remained unserved for appellant no. 2 and has been served to
appellant no. ½ to 1/5. Notice remained unserved for
respondent no. 4 who expired. Learned advocate Mr. GD Bhatt
appearing for respondent nos. 1 and 2 though Rule served to
respondent no. 3 no appearance is filed by respondent no. 3.

In
light of this back ground that no appearance is filed by appellant
no. ½ to 1/5 and no advocate is engaged though notice has
been served and considering being an old matter of the year 1982.
Therefore, in their absence, present second appeal is dismissed in
default.
