This matter was heard on 20.01.2010. Appellant was absent when
called, while the respondents were represented by Shri Gaurav Kumar,
Deputy Secretary & Appellate Authority and Shri C.K. Rawat, Under
Secretary & CPIO.
2. Respondents pointed out that the information which the appellant
has requested is entirely in the domain of the State Governments, i.e.
letters of intent and execution of mining lease, among others. The
Central Government (i.e. Ministry of Mines) had nothing to do with
these and, therefore, did not hold any information.
3. In view of what has been stated by the respondents, the matter is
not within the jurisdiction of the Central public authority and hence no
responsibility can be cast on the public authority to disclose the
requested information in appellant’s RTI-application dated 27.03.2009.
4. Appeal closed.
5. Copy of this direction be sent to the parties.
