Heard learned counsel for the petitioner and the learned Standing Counsel.
Notice on behalf of opposite parties no.1 to 3 has been accepted by the
learned Standing Counsel, who prays for and is granted four weeks’ time to
file counter affidavit. Two weeks thereafter is allowed to the counsel for the
petitioner for filing rejoinder affidavit.
Issue notice to opposite party no.4.
List thereafter.
Learned Standing Counsel was directed to seek instructions, but the
instructions which have been furnished to the Court are repetition of the
contents of the letter written by Jiya Lal Tyagi, Vice President, Rajya Safai
karmchari Aayog. He further states that no person has joined in place of the
petitioner up till now.
Counsel for the petitioner submits that in pursuance to the direction of this
Court the petitioner has taken all positive measures to get the illegal
constrictions demolished, but the said constructions are of interested persons
comprising of MPs, MLAs and other political persons and big businessmen
and the said action of the petitioner has resulted in writing of the latter against
him and on that basis he has been transferred. He further submits that the
petitioner has been made victim for implementing the order of this Court.
Considering the aforesaid facts, the operation of the transfer order dated
21.7.2010 shall remain stayed and the petitioner shall be paid his salary
regularly every month.
