02 21.07.2011 Heard learned counsel for the petitioner as well as

learned Additional Public Prosecutor for the State.

Petitioner is languishing in jail custody since 20.01.2011

in a case registered under Sections 386/34 of the Indian Penal Code on

the allegation that he demanded extortion money from the informant

and subsequently, the mobile phone of the petitioner was seized.

The contention of learned counsel for the petitioner is

that informant is agnate of the petitioner and, as a matter of fact, on

account of previous enmity, the informant lodged the present case

whereas one another agnate of the petitioner lodged Chainpur P.S.

Case No. 02 of 2011 on the same day against the petitioner and except

the aforesaid two cases, there is no any other criminal antecedent of

the petitioner.

Considering the aforesaid facts and circumstances as

well as submissions of the parties, let the petitioner be released on bail

on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two

sureties of the like amount each to the satisfaction of Chief Judicial

Magistrate, Kaimur at Bhabua in connection with Chainpur P.S. Case

No. 03 of 2011.
