3 20/10/2011 Heard Counsel for the petitioner, the private

respondents and the State.

The petitioner claimed that the private

respondents no. 3 to 8 have encroached upon the lands

appertaining to khata no. 271, plot no. 482/1537 area

3 acres 9 decimals, thana no. 215 within the circle

Ramgrah in the district of Kaimur at Bhabhua.

Learned Counsel appearing on behalf of the

State submits that the lands in question are public

lands and the petitioner and the private respondents in

connivance with each other have encroached upon the

public land.

Learned Counsel for the petitioner submits

that a notice has already been issued to the petitioner

and the private respondents by initiating

Encroachment Case No. 04 of 2007-08.

In the circumstances, I direct that the

encroachment case may be decided expeditiously

preferably within a period of four months from the date

of receipt/production of a copy of this order.

This writ application is disposed of with the

aforesaid observations and directions.
