The report of the Local Commissioner has been perused. It

reveals that the contention of learned counsel for the respondents as

recorded on 19.12.2008 was less incorrect than the contention of learned

counsel for the appellant.

In the circumstances, this appeal is dismissed, in view of the

order of this Court dated 19.12.2008.
