FACTS

By his letter of 03/12/2007, the Appellant had requested for copies of documents
relating to shop No.78, Mall Road, Guru Teg Bahadur Nagar, Delhi-09. CPIO had
responded to him vide letter dated 02/01/2008 to say that he could collect the copies of
documents after depositing Rs.522/-. As he did not receive copies of the documents, he
had filed an appeal which was dismissed by Appellate Authority vide order dated
28/02/2008.
2. Hence, the present Appeal.
3. The matter was heard on 20/02/2009. The Appellant appeared before the
Commission. The Public Authority is represented by the officer named above. It is the
submission of the Appellant that he had deposited the requisite amount on 07/01/2008
and, therefore, should have been provided copies of the documents on the same very day.
It is also his submission that he kept waiting in DDA Office till 6.00 P.M. but the
documents were not delivered to him; nor was he told that be this could not be done that
day and that he would have to come later, resulting in wastage of his time. He would
submit that as the documents were not provided to him on that very day, the amount
deposited by him should be refunded.
4. On the other hand, it is the submission of Shri Sharma that after the Appellant had
deposited the requisite amount on 07/01/2008, PIO had written to the Appellant on
18/01/2008 to collect the documents. As the Appellant did not come to take the
documents, as per noting dated 12/02/2008 in the relevant file, the documents were sent
to the Appellant’s house by a Special Messenger but he refused to accept the same but the
documents were subsequently provided to him.
5. When queried as to whether he had refused to take the delivery of the documents,
the Appellant would submit that no Special Messenger came to his residence. To
another query, the Appellant would submit that he has since received the documents by
post but does not remember the date thereof.

6. The main question for consideration is whether the Special Messenger visited the
residence of the Appellant for delivery of documents and, if yes, on which date and
whether the Appellant refused to accept the documents.
INTERIM DECISION
7. Shri R.K. Sharma is hereby directed to ask the Special Messenger to file an
affidavit in this regard in three weeks time. The matter would come up for hearing on
06/04/2009 at 10.30 hrs.
