Heard learned counsel for the petitioner and learned standing
counsel.
It is contended by learned counsel for the petitioner that the
petitioner is a Assistant Sub-Inspector (M) in U.P. Police. He was
posted in District Varanasi where he has been allowed an official
accommodation. Now he has been posted at Ramgarh within the
same district but he has been asked to vacate the official
accommodation.
The submission of the learned counsel for the petitioner is that as
the petitioner continues to remain posted in the same district he
can not be directed to vacate the accommodation. He has placed
reliance upon the D.O. order dated 1.10.1996 which provides that
unless and until district headquarter of the employee is changed he
may not be dispossessed from the accommodation alloted.
Learned standing counsel prays for and is allowed three weeks’
time for filing counter affidavit.
List thereafter.
Till the next date of listing the petitioner shall not be dispossessed
from the house in dispute.
