Heard Sri R. P. Tiwari, Advocate appearing for the applicant and AGA for the
State.
The only prayer made in this application under section 482 Cr.P.C. is that the
Court below be directed to decide the case no. 3764 of 2009 (State Vs. Vikas
Anand and others) under section 386, 506 IPC, P.S. Ijjat Nagar, Bareilly
pending in the court of Chief Judicial Magistrate, Bareilly expeditiously.
The main submission made by learned counsel is that the applicant is a retired
govt. servant, who is facing trial in case no. 3764 of 20009 for a long time.
Having regard to all the facts and circumstances of the case, the court below is
directed to decide the case no. 3764 of 2009 (State Vs. Vikas Anand and
others) under section 386, 506 IPC, P.S. Ijjat Nagar, District Bareilly pending
in the court of C.J.M. Bareilly expeditiously if possible within a period of four
months from the date of filing certified copy of this order by making sincere
efforts and applying section 309 Cr.P.C.
With this direction, the application under section 482 Cr.P.C. is disposed of
finally.
