     Background

1. The   RTI   Application   was   filed   on   26.8.2009   with   PIO,   Solapur   Division,   Solapur 

requesting for the following information : names of the candidates who were trained under the 

Apprenticeship Act in 1961 year­wise and trade­wise; the list of candidates who had passed the 

NCTVT Examination. He also sought information against other misc. points. The PIO replied on 

6.10.2009 enclosing the information made available by the Assistant Personal Officer­cum­Nodal 

Officer, RTI, Solapur. The Appellate Authority replied on 14.12.2009 providing further clarification. 

He also invited the Applicant to inspect the files if he so desires. Still not satisfied satisfied, the 

Applicant filed his Second Appeal on 19.12.2009 requesting for the information once again.

2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing 

for May 11, 2010.  

3. Mr.   Durgesh   Katara,   Sr.   DC   cum   PIO,   Mr.   V.S.P   Raj,   APO   cum   Nodal   Officer 

represented  the Public Authority and were heard through video conferencing.

4. The Appellant was heard  through video conferencing.   

Decision

5. The Appellant stated that he is still to receive information against points 2, 3, 4 and points 

6, 7, 8.   The Respondents submitted that there is absolutely no information on record 

about any Examination having taken place during the period 1992 to 1998 and hence no 
information   as  sought   in   points  2,3,4   and  points  6,7,8   regarding   candidates  who   had 

appeared in the Examination or have failed in the Examination is available   in the files, 

thereby   indicating   that   no   such   exam   was   ever   held.     The   Commission     accordingly 

directs the PIO to provide an Affidavit to the Commission affirming the non availability of 

the information in the records with a   copy to the Appellant.   Information to be made 

available by 10.06.2010.   

6. The appeal is accordingly disposed of.
