ORDER

Appellant
original complainant Regional Director has filed this Appeal
challenging the order dated 8.3.2003 passed by the learned JMFC,
Wankaner, in Criminal Case No. 361 of 1993.

Heard
learned Advocate Mr. Gade for the appellant, learned APP Shri Vyas
for the respondent No.1 State and learned Advocate Mr. Shah for
the respondents No.2 & 4. I have also perused the papers
produced before me.

Learned
Advocate Mr. Gade has contended that the order passed by the learned
Magistrate is not proper in eye of law. He has contended that the
learned Magistrate has never called the complainant during the
hearing of matter for
settlement in Lok Adalat. He, therefore, contended that the order
passed by the learned Magistrate may be quashed and set aside.

Learned
APP Mr. Vyas and Learned Advocate Mr. Shah have supported the order
passed by the learned Magistrate.

I
have gone through the order passed by the learned Magistrate. I have
also perused the papers produced before me. It clearly appears that
the case is disposed of in the Lok Adalat and when the case is
settled in the Lok Adalat, that order cannot be challenged by way of
Appeal before this Court.

Accordingly,
the Appeal fails and is hereby dismissed.
