This is an application for disposal of appeal.

Learned counsel for the applicant-appellant restricts his

prayer to the grant of interest only.

Learned counsel for the parties agreed that the present

appeal is covered by the judgment rendered by this Court on

23.09.2009 in FAO No.690 of 2009 titled as Sikander Singh versus

Union of India.

In view of the said statement made by learned counsel

for the parties, the appeal is allowed and the interest shall be now
CM No.22666-CII of 2009 and
FAO No.432 of 2008

awarded @9% on the amount so awarded by the Railways Tribunal

from the date of the claim petition till the payment was so made.

Allowed in the same terms as in FAO No.690 of 2009

decided on 23.09.2009.
