Heard learned counsel for the applicant, learned AGA appearing for the State
and perused the record.
It is contended by learned counsel for the applicant that in FIR there is no
specific allegation against the applicant and thereafter a recovery of two
‘vasla’ have been shown on pointing out by the applicant which is a sharp
cutting weapon and in postmortem report no incised wound has been found.
Learned AGA contended that applicant was also involved in inflicting injury
to the deceased person.
In FIR no specific weapon has been assigned to the applicant and there is
general allegation. In postmortem report no incised wound has been found.
Applicant has no criminal history. He is in jail since 27.3.2010.
Considering the facts and circumstances of the case and submissions made by
the learned counsel for the applicant and without expressing any opinion on
the merits of the case, the applicant is also entitled to be released on bail.
Let the applicant Naubahar Singh involved in Case Crime No. 89/2010, u/s
147, 148, 149, 302 IPC, P.S. Kiratpur, District Bijnor be released on bail on
his furnishing a personal bond with two sureties each in the like amount to the
satisfaction of the court concerned.
