                                 JUDGMENT

The petitioner is working as Special Grade Secretary in

Wadakanchery Grama Panchayat. He is working in the said cadre

from 18.09.1996. The petitioner has passed Minority Language Test

in Tamil, conducted by the Public Service Commission. Petitioner is

the beneficiary of Rule 9(d) of Part II K.S.&S.S.R.

2. The next promotion post is that of Performance Audit

Supervisor/Senior Superintendent in the Panchayat Service. The

benefit of Rule 9(d) has been extended upto the cadre of Taluk

Panchayat Officer. It is evidenced as Ext.P1. The post of Taluk

Panchayat Officer has now been re-designated as Performance Audit

Supervisor. The petitioner has made a request by way of Ext.P2

claiming promotion.

3. The main relief sought in the writ petition is for a direction

to the second respondent to promote the petitioner as Performance

Audit Supervisor in one of the vacancies available in the Tamil

Lingistic Minority Areas like Thiruvananthapuram, Peerumedu,

Adimaly, Nedumkandom etc. or in the alternative direct the second

respondent to consider Exts.P2 and P5 under Rule 9(d) of K.S.&S.S.R

in the light of Exts.P1 and P3.

4. Since Exts.P2 and P5 are pending before the second respondent,

there will be a direction to the second respondent to consider and pass

orders on Exts.P2 and P5 in accordance with the relevant provisions of

KS & SSR along with the applications, if any, submitted by other eligible

officers. Appropriate orders shall be passed within a period of six weeks

from the date of receipt of a copy of this judgment.

The writ petition is disposed of as above.
