2. In this case the Appellant had, in his application dated 29 October
2008, requested the CPIO for a number of information in respect of some
banners displayed in the car parking area of the regional office of the Bank.
In his reply dated 13 November 2008, the CPIO explained the circumstances
in which the banners had been put up and clarified that the Bank had
incurred no cost in this respect. He further explained that the display had
not been sponsored by anyone and that the cost had been met by the staff
and that there was no violation of any conduct rules. Not satisfied with this
reply, he had preferred an appeal on 26 November 2008 which the Appellate
Authority disposed of in his order dated 31 December 2008. The Appellate
Authority, had in a speaking order, rejected the appeal and endorsed the
response of the CPIO. The Appellant has come to the CIC in second appeal
against this order.
3. We heard this case through videoconferencing. The Appellant was
present in the Mangalore studio of the NIC whereas the Respondent was
present in the Bangalore studio. We heard their submissions. After carefully
examining the request for information and the reply of the CPIO and the
CIC/SM/A/2009/000533
order of the Appellate Authority, we are of the considered opinion that
there is nothing more the CPIO could have provided in this regard than what
he has already stated. Once it is admitted that the Bank had not sponsored
these banners and that these were put up by the staff on their own, there is
no record in the possession of the Bank to be shared with the Appellant.
There is no merit in this appeal. The case is, thus, disposed off.
4. Copies of this order be given free of cost to the parties.
