Shri
Pradeep Patel, learned advocate appearing for the petitioner seeks
permission to withdraw this petition without making submission on
merits and prays that the Court may direct the respondent before
whom the revision application is pending to decide it expeditiously.
Learned AGP appearing on advance copy submitted that the request for
regularization is turned down by the District Collector and the
revisional authority has rejected prayer for interim relief. In view
of this, the Court may pass appropriate order.
This
Court is of the view that when the citizen is before the authority
with an application under the remedy provided under the statute, the
authority is under an obligation to dispose of it as expeditiously
as possible, and therefore, without expressing any opinion on merit,
it is appropriate to direct the respondent before whom the revision
application is pending, to dispose of the same as expeditiously as
possible, preferably within six months from the date of receipt of
writ of this order. With this observation the permission as sought
for is granted. Petition is disposed of as withdrawn. No order as to
cost.
It
goes without saying that the authority concerned shall decide the
revision application without being influenced by the fact that
present petition is withdrawn from the Court. Direct service
permitted.
