Background
1. The Applicant filed an RTI request dt.6.8.08 with the CPIO, BSNL, Pune. He
requested for the following information with regard to his letter dt.6.6.08
addressed to Mr. S. S. Bhosale, AGM (Complaints) which was submitted on
16.6.08:
i) What action has been taken on his application?
ii) What type of complaint registration system does BSNL have for Cell
One Customers who want to register complaints regarding ‘Do Not Call’
guideline non-compliances
iii) Can such complaints be registered on BSNL Cell One Customer Care
No.9422024365
On not receiving any reply, he filed a complaint dt.26.12.08 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the
hearing for March 19, 2009.
3. Mr. R.K. Maheshwari, DGM & CPIO represented the Public Authority.
4. The Complainant was not present during the hearing.
Decision
5. The Respondent submitted that the RTI request and appeal were not received
since the letters were sent to the wrong address and hence the reply could
not be provided. He came to know about the RTI request only after receiving
the hearing notice. He stated that he has come with the reply dated 19.3.09
to the hearing and shared a copy of the same with the Commission.
6. The Commission directs the CPIO to send the reply to the Appellant
immediately so that the Complainant receives it before the end of March,
2009
7. The appeal is disposed off.
