The
applicant has sought temporary bail for 10 days for receiving and
depositing the amount of gratuity, which he is now likely to receive.
The application is annexed with letter dated 8.8.2011 of the company,
who appears to have employed the applicant. According to that letter,
the company has received a cheque of Rs. 86,801/- towards the
gratuity, which is required to be collected by the applicant.
However, the letter itself states that if the amount is to be
received by applicant’s aged parents, he can authorise someone by a
letter counter singed by Jailor. Thus, the applicant is not required
to personally go for collecting the cheque and deposit it into his
bank account. It also appears from the record that earlier
application being Criminal Misc. Application No. 4055/2011 has been
rejected on 25.3.2011 and even thereafter, he has been released for
15 days in May, 2011 on the same ground. Under the circumstances, the
present application is rejected.
